Defending the independence of Al-Azhar and the competencies of its bodies, the Grand Imam requests attending a Plenary Session of the House of Representatives to Explain the Vision of Rejecting the Fatwa Bill

Today, Sunday, August 23, 2020, His Eminence the Grand Imam of Al-Azhar Prof. Dr. Ahmad At-Tayyeb sent a letter to Dr. Ali Abdel-Aal, Speaker of the House of Representatives, in which he requested attending the plenary session held to discuss the draft law regulating Dar ul-ˀIftāˀ work, in case of insistence on approving the bill despite its constitutional flaws. The request comes in fulfillment of the trust bestowed by Allah Almighty upon His Eminence and to present Al-Azhar’s vision on that project whose approval would produce an entity parallel to the bodies of Al-Azhar, subvert its message, and undermine the competencies of its bodies. The Grand Imam stressed that the Egyptian constitution makes Al-Azhar alone the main reference in religious sciences and Islamic affairs, and the authority responsible for advocating and spreading religious and language sciences in Egypt and the world. He also added that, as a given, the legal fatwa is part of the Islamic affairs and religious sciences, the supervision and review of which lies within the competencies of Al-Azhar Ash-Sharif. In his letter to the Speaker of Egypt's House of Representatives, the Grand Imam pointed out that indications in former correspondences were made to Al-Azhar reservations against Al-Ifta Bill, including the bill’s contradiction with the provisions of Article 7 of the constitution and with the applicable Al-Azhar Law, which stipulates Al-Azhar established competencies over hundreds of years through successive laws. Regarding the justifications for this reservation, His Eminence also attached the Council of Senior Scholars’ opinion of the draft law, as well as a copy of the circulating report of the State Council’s Legislation Department. He thus averred in his letter, "Today I introduce to the Egyptian people's representatives - who are entrusted with the preservation of Egypt’s ancient institutions and who took the oath to respect the constitution" – a copy of the report of the State Council’s Legislation Department, in its capacity as the body competent to review draft laws. Drawing on an objective study of the draft law referred to by the House of Representatives, the report concludes that it includes explicit violation of the provisions of the constitution, conflicting with the constitutional and legal competencies of Al-Azhar Ash-Sharif. The reasons behind this opinion fall in line with the opinion of the jurists and professors of constitutional law, and with the study conducted by Al-Azhar on the draft law, which was previously presented to you on March 1, 2020, to be distributed to the representatives before voting on the bill.
